Declaration of Restrictive Covenants

Original Declaration - Phase 1 - This file is the original declaration of restrictive covenants for the neighborhood which was recorded in 1997. This covenant initially applied only to lots in Phase 1.

Supplemental Declaration – Phase 2 - This supplemental declaration was recorded in 1998. It initially applied only to lots in Phase 2. It declares that all previously recorded covenants also apply to Phase 2. It adds the following new restrictions: no vinyl or aluminum siding, no recreational vehicles (described in covenants) can be used off owner’s property, no
chain link fences.
**Note: The new restrictions in this supplemental declaration do not apply to
Phase 1.

Supplemental Declaration – Phase 2A - This supplemental declaration was recorded in 2000. It declares that all previously recorded covenants apply the lots in Phase 2A. No new restrictions were added to this supplemental declaration.

Amendment to Declaration – HOA/Pool - This amendment to the declaration created the Homeowners Association (HOA) and the Swimming Pool Association (SPA) and was recorded in 2000.

The requirement to be a member of the HOA applied to all undeveloped property in Ole Mill Stream (including Phase 2A and the future Phase 3)) and any lot in Phases 1 and 2 when the homeowners declared their intent to become members in this original amendment or who have declared their intent since this amendment.

The requirement to be a member of the SPA applied to all undeveloped property in Ole Mill Stream (including Phase 2A and the future Phase 3). Homeowners in Phases 1 and 2 are not required to belong to the SPA until they declare intent with the SPA and a deed is recorded.

**Note: After any lot owner in Phase 1 or 2 joins either the HOA or the SPA, a
deed is recorded with the Johnston County Register of Deeds against the lot.
The requirement to be a member of either the HOA or the SPA conveys with
the lot to any new homeowners.

Supplemental Declaration – Phase 3 This supplemental declaration was recorded in 2002. It declares that all previously recorded covenants apply to the lots in Phase 3 and adds the following new restrictions: raises minimum dwelling size to 2100 sq. ft. with minimum 2 car side entry garage, additional requirements for design of accessory buildings, information about building setbacks, information about off-site septic tank
fields and repair areas, fences no higher than 4 feet, prohibition for on street parking (except construction vehicles when necessary), and commercial vehicles, motor homes and trailers stored out of view from front and side lots, requirement for concrete driveways (except specified lots).

**Note: The new restrictions in this supplemental declaration do not apply to
Phases 1, 2 and 2A. However, all septic tanks are required to be properly
maintained by the Johnston County Health Department.

Partial Delegation Agreement - This document transferred the architectural review requirements from the developer to the HOA Board of Directors for existing property. The developer retained the review rights for all NEW construction.
